U.s. State Privacy Notice

We honor your rights under the Virginia Consumer Data Protection Act (“VCDPA”), California Consumer Privacy Act (“CCPA”), California Privacy Rights Act (“CPRA”) and other similar U.S. state privacy laws. This Notice supplements our Privacy Policy and is also incorporated into our Terms of Use and applies to all visitors, users, and others who are residents of California or residents of U.S. states with privacy laws similar to the CCPA and CPRA ("consumers" or "you"). Along with information on the data we collect, this policy explains your rights by law and has instructions and contact information to help you exercise these rights.

Information We Collect:

We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device ("personal information"). Personal information does not include:

  • Publicly available information from government records.
  • Deidentified or aggregated consumer information.
  • Information excluded from a state privacy law's scope, like:
    • health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA); or
    • personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FCRA) or the Gramm-Leach-Bliley Act (GLBA).
In particular, we have collected the following categories of personal information from our customers within the last twelve (12) months:

We obtain the categories of personal information listed above from the following categories of sources:

  • When establishing an account with us, or placing an order on our Website.
  • When you visit our Website and use our Services.
  • When you participate in our forums, surveys, contests, sweepstakes, promotions, content submissions, chats, bulletin boards, discussion groups, requests for suggestions, and membership registrations.
  • When you report a problem with our Website.
  • Records and copies of your correspondence (including email addresses), if you contact us, including email, voice and chat transcripts.
  • Your search queries on our Website.
  • When you communicate with any of our departments such as customer service, sales or technical services.

Use of Personal Information:

We may use or disclose the personal information we collect for one or more of the following purposes:

  • To protect us from misuse of our websites and fraudulent orders.
  • To process the return of the products and the refund of purchase prices.

  • To remind you of any purchasing processes you have not yet completed.

  • To provide our Website, Services and content to you and to promote the stability and security of our Website, Services and content.
  • To provide you with information, products or services and to communicate with you about information that you request and answer your questions. This includes sending you newsletters, marketing emails and to inform you about our products, services and promotions, and notifying you about changes to our Website.
  • To understand and know how our products work and sell, the effectiveness of our marketing campaigns, the effect of our websites and the overall user experience and to generally improve our product strategy and user experience design.
  • To provide certain forms of functionality throughout our Website (such as to save your cart when you leave our Website) including providing a localized version of the Website.
  • To allow you to customize the direct marketing sent to you based on your preferences/interests.
  • To show you individual recommendations on our Website based on this data. When you visit our website, cookies and similar tracking technology (e.g., "Pixels") are set by our retargeting provider(s) to track which products you have viewed or purchased on our Website. Using this information, we may then show you individual offers of products on third-party websites through our retargeting provider(s) and analyze the results to further improve our ads.
  • To generate personas, personal preferences, market trends from algorithmic and language processing/analysis.
  • As described to you when collecting your personal information or as otherwise set forth in applicable U.S. state privacy law.

We may also use or disclose the personal information we collect to enforce and/or defend our rights and to the extent necessary for any resulting legal dispute; to perform risk assessments such as due diligence investigations; and to respond to law enforcement requests and as required by applicable law, court order, or governmental regulations; to evaluate a sale or transfer of some or all of our assets, which personal information held by us about our customers is among the assets transferred.

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

How Long We Retain Your Personal Information:

We will keep the personal information we collect about you for as long as necessary to carry out the purposes set forth in this Privacy Notice or any other notice provided at the time of data collection, but no longer than as required or permitted under applicable law. We dispose of the information we collect in accordance with our retention policies and procedures.

Disclosing of Personal Information:

We may disclose your personal information to a third party for a business purpose. When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract. We share your personal information with the following categories of third parties:

  • Service providers (such as IT services, and website hosting companies).

  • Third-Party Marketing Partners.
  • Third-Party Service Providers.

Category M: Account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account.

Sales and Sharing of Personal Information:

We do not sell your data. In the preceding twelve (12) months, we have shared the following types of personal information to other companies:

- Basic Identifying Information with businesses, service providers, and third parties, such as advertising networks, analytics and social media networks.

- Device Information and Other Unique Identifiers with businesses, service providers, and third parties, such as advertising networks, analytics, and social media networks.

- Internet or Other Network Activity with businesses, service providers, and third parties, such as advertising networks, analytics, and social media networks.

- Approximate Geolocation Data with businesses, service providers, and third parties such as advertising networks, analytics, and social media.

- Payment Information with businesses and service providers who process payments.

- We disclose Commercial Information with businesses, service providers, and third parties, such as advertising networks, analytics, and social media networks.

- User Content with businesses and service providers who help administer our programs, such as site and product review networks.

- Audio and Visual Information with businesses and service providers who help administer fraud prevention services.

- Inferences with businesses and service providers who help administer marketing and personalization

Sales and Sharing of Sensitive Personal Information:

We do not sell or share your sensitive personal information. In the preceding twelve (12) months, we have not sold or shared any sensitive personal information with third parties.

Your Rights and Choices:

California and Virginia Privacy Law provide consumers with specific rights regarding their personal information. This section describes those rights and explains how to exercise them.

Access to Specific Information and Data Portability Rights: You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past twelve (12) months. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting, selling or sharing that personal information.
  • The categories of third parties to whom we disclose personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request).
  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
    • sales, identifying the personal information categories that each category of recipient purchased; and
    • disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

Deletion Request Rights: You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • 1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.
  • 2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • 3. Debug products to identify and repair errors that impair existing intended functionality.
  • 4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • 5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  • 6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  • 7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • 8. Comply with a legal obligation.
  • 9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Opt-Out of the Sale of Personal Information.

We do not sell your personal information to third parties.

Opt-Out of Targeted Advertising.

You may opt-out of being tracked online by certain companies who are listed at https://www.aboutads.info/ or https://www.networkadvertising.org and you may also learn more about online behavioral advertising at such websites. After withdrawing your consent at any of the mentioned websites, you will still receive generic advertisements, but advertisements will not be delivered to you based upon the data possessed by those companies from whom you have opted-out. You may also opt out of tracking by our partner Criteo, who helps us to personalize your experience and advertise to you across platforms after you've interacted with our website or other content across the web. To withdraw your consent from Criteo, please visit them at https://www.criteo.com/privacy/disable-criteo-services-on-internet-browsers/. These opt-out processes rely upon an opt-out cookie for each browser and each device, so if you delete your cookies or use a different computer, you will have to repeat this process. We do not respond to or honor "do not track" (a/k/a DNT) signals or similar mechanisms transmitted by web browsers.

Opt-Out of Profiling for Legal or Similar Significant Effects.

We currently do not use your personal information for these purposes.

Confirm Whether or Not We are Processing your Personal Information.You have the right to request that we disclose to you whether or not we are processing your personal information.

Access to Portable Data. You have the right to request that we provide to you a copy of any personal information that you have previously provided to us in, to the extent technically feasible, a portable readily usable format.

Correction Request Rights.You have the right to request that we correct inaccuracies in your personal information, subject to certain exceptions.

Exercising Your Rights: To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Making a verifiable consumer request does not require you to create an account with us.

We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request

Response Timing and Format: We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to forty-five (45) days), we will inform you of the reason and extension period in writing.

We will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights. Unless permitted by the applicable law, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Right to Appeal. According to Virginia law, if we refuse to take action on your verifiable consumer request you can appeal the request by emailing: [email protected]. We endeavor to respond to your appeal within sixty (60) days of its receipt. In our response, we shall provide you with an explanation of any action taken or not taken in response to your appeal, including a written explanation of the reasons for the decisions

Changes to This Notice

We reserve the right to amend this privacy notice at our discretion and at any time. When we make changes to this privacy notice, we will post the updated notice on our Website and update the notice's effective date. Your continued use of our Website following the posting of changes constitutes your acceptance of such changes.
